1. Overview
Welcome to TLC PureOrigin. TLC PureOrigin is a trading name operated by TLC NeuroMicrobiome Labs Inc. In these Terms of Service (“Terms”), “TLC PureOrigin,” “we,” “us,” and “our” refer to TLC NeuroMicrobiome Labs Inc.
We operate this website and online store, including all related information, content, features, tools, products and services (collectively, the “Services”). Our online store is powered by Shopify.
These Terms, together with any policies linked or referenced below, govern your access to and use of the Services. By visiting our website, creating an account, placing an order or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
2. Eligibility and Customer Accounts
You must be at least the age of majority in your province, territory, state or country of residence to use the Services or place an order.
You agree to provide current, complete and accurate account, billing, payment and shipping information. You are responsible for protecting your account credentials and for all activity under your account. You may not sell, transfer or share your account with another person.
3. Educational and Health Information
Information provided through the Services—including articles, calculators, videos, research summaries, product explanations and other educational material—is for general informational and educational purposes only.
It is not individualized medical advice and is not intended to diagnose, treat, cure or prevent any disease or health condition. It is not a substitute for advice from a physician, registered dietitian or other qualified healthcare professional.
Consult a qualified healthcare professional before using any product if you are pregnant or nursing, take medication, have a medical condition or allergy, or have questions about whether a product is appropriate for you. Always follow the product label and directions for use. Individual results vary, and no particular health, fitness or performance outcome is guaranteed.
4. Product Information and Natural Variation
We make reasonable efforts to present product descriptions, ingredients, nutrition information, images and colours accurately. However, screen settings, photography and production changes may affect how a product appears online.
Our products contain agricultural and food ingredients. Minor differences in colour, flavour, aroma, texture, density or mixability can occur between lots. Some TLC PureOrigin protein powders are intentionally non-instantized and made without lecithin, gums, anti-caking agents or emulsifiers. Natural clumping or different mixing behaviour does not necessarily indicate a defect.
If we make a material change to a product, we will update the applicable product information as reasonably practicable.
5. Orders and Order Acceptance
Your order is an offer to purchase. An automated order confirmation acknowledges that we received your order but does not necessarily mean that we accepted it. We accept an order when payment is processed and the order is approved for fulfilment.
We may decline, limit or cancel an order for reasons including product availability, suspected fraud, payment issues, pricing or description errors, unusual quantities, or legal or regulatory requirements. If we cancel an order after payment has been collected, we will refund the cancelled amount to the original payment method.
Please review your order carefully before submitting it. We may not be able to change or cancel an order once fulfilment begins. Products purchased through the Services are intended for personal or household use and not for unauthorized resale or export.
6. Prices, Taxes and Payment
Unless otherwise stated, prices are shown in Canadian dollars. Prices, discounts and promotions may change without notice. The price submitted with your order is subject to correction if there is an obvious error.
Applicable taxes, shipping charges and other fees will be shown before checkout when required. You authorize us and our payment providers to charge your selected payment method for the total amount shown at checkout.
Promotions may be subject to additional terms, eligibility requirements, limits and expiry dates.
7. Subscriptions
When you purchase a subscription, it renews automatically at the frequency shown at checkout—currently monthly—until you cancel it. You authorize recurring charges to your selected payment method for each renewal order, including applicable taxes and shipping charges.
You can use your customer account to view, pause, resume, skip or cancel a subscription. Changes must be completed before the next scheduled billing date. If an order has already been processed, the change will apply to future renewals. We do not charge a subscription cancellation fee.

If we make a material change to a subscription price or other important subscription terms, we will provide notice as required by law and give you an opportunity to cancel before the change takes effect.
8. Shipping and Delivery
Shipping methods, costs and estimated delivery times are described in our Shipping Policy.
Delivery dates are estimates and may be affected by carriers, weather, customs, labour disruptions, peak periods, incorrect addresses or other circumstances outside our reasonable control. We will address reported lost, damaged or incorrectly delivered orders in accordance with our policies and applicable law.
You are responsible for reviewing the shipping address before submitting your order.
9. Returns and Refunds
Eligibility, time limits, exclusions and instructions for returns and refunds are set out in our Return and Refund Policy. Please contact us before sending a product back.
Nothing in these Terms limits any non-excludable rights or remedies available to you under applicable consumer-protection law.
10. Privacy
Our collection, use and disclosure of personal information are described in our Privacy Policy.
Because our store is hosted by Shopify, Shopify also processes personal information in connection with the Services. You can learn more in Shopify’s privacy information for consumers.
11. Intellectual Property
The Services and their content—including our names, trademarks, logos, product names, text, graphics, photographs, videos, designs and software—are owned by or licensed to us and are protected by Canadian and international intellectual-property laws.
We grant you a limited, revocable, non-exclusive and non-transferable right to access and use the Services for personal, lawful and non-commercial purposes. You may not reproduce, distribute, modify, publish, sell, license, reverse engineer or commercially exploit any part of the Services without our prior written permission or other lawful authorization.
No right, title or interest in the Services or their content is transferred to you.
12. Feedback and Reviews
If you submit a review, testimonial, comment, idea, image or other feedback, you confirm that you have the right to provide it, that it is truthful, and that it does not violate another person’s rights or applicable law.
You grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, reproduce, adapt, publish, translate and display that content in connection with our business and Services, subject to applicable privacy and advertising laws.
We may moderate or remove content that is unlawful, misleading, abusive, infringing, fraudulent, obscene or otherwise inappropriate. If you received an incentive for a review or endorsement, you must disclose it clearly.
13. Optional Tools and Third-Party Links
The Services may include links to, integrations with or access to third-party websites, applications, tools, payment providers or services. We do not control those third parties and are not responsible for their content, availability, security, privacy practices or terms.
Your use of third-party services is at your discretion and may be governed by separate terms. Review those terms before use and direct concerns about a third-party service to that provider.
14. Relationship With Shopify
Our online store is powered by Shopify, but purchases made through the Services are transactions between you and TLC NeuroMicrobiome Labs Inc. Shopify is not the seller of our products and is not responsible for fulfilling your order, product claims, returns, refunds or customer service.
To the extent permitted by law, you release Shopify and its affiliates from claims arising solely from transactions between you and us.
15. Errors, Availability and Corrections
The Services may occasionally contain typographical errors, inaccuracies or omissions relating to product information, pricing, promotions, shipping charges, delivery estimates or availability.
We may correct errors, update information, limit quantities, or cancel affected orders as reasonably necessary and permitted by law. If we cancel an affected paid order, we will provide an appropriate refund.
16. Prohibited Uses
You may use the Services only for lawful purposes. You may not:
- violate any applicable law or another person’s rights;
- infringe intellectual-property, privacy or publicity rights;
- submit false, misleading or fraudulent information;
- upload malicious code, viruses or harmful technology;
- gain or attempt to gain unauthorized access to the Services, accounts or systems;
- scrape, harvest or commercially exploit the Services or personal information without authorization;
- interfere with security, availability or normal operation of the Services;
- impersonate another person or misrepresent your identity; or
- send spam or other unauthorized communications.
We may restrict or terminate access for a prohibited use.
17. Termination
You may stop using the Services at any time. We may suspend or terminate access when reasonably necessary to address unlawful activity, fraud, security risks, misuse or a material breach of these Terms.
Termination does not affect payment obligations, rights or liabilities that arose before termination. Provisions that by their nature should survive termination will continue to apply.
18. Disclaimer of Warranties
Except for warranties or conditions that cannot lawfully be excluded, the Services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, timely, secure or error-free.
Nothing in these Terms excludes any express product warranty we provide or any statutory warranty, condition, guarantee or remedy that cannot be excluded under applicable law.
19. Limitation of Liability
To the fullest extent permitted by law, TLC NeuroMicrobiome Labs Inc. and its directors, officers, employees, affiliates, agents, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential damages arising from your use of, or inability to use, the Services or products.
These Terms do not limit liability or consumer remedies that cannot legally be limited. Where liability may lawfully be limited, our aggregate liability for a claim relating to a product will not exceed the amount you paid for that product, except where applicable law requires otherwise.
20. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless TLC NeuroMicrobiome Labs Inc. and its directors, officers, employees, affiliates, agents and service providers from third-party claims, damages, liabilities and reasonable costs arising from your unlawful misuse of the Services, your material breach of these Terms or your infringement of another person’s rights.
This obligation does not apply to the extent a claim or loss was caused by our own negligence, misconduct or breach, or where indemnification is prohibited by law.
21. Governing Law
These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable there, without regard to conflict-of-law principles.
Subject to any mandatory consumer rights regarding venue or jurisdiction, disputes will be submitted to the courts located in Winnipeg, Manitoba.
22. Changes to These Terms
We may update these Terms to reflect changes to our Services, business practices or legal obligations. The current version will be posted on this page with an updated “Last updated” date. Where required, we will provide additional notice of a material change.
Changes will not apply retroactively unless required by law.
23. Severability, Waiver and Entire Agreement
If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver. These Terms and the policies referenced in them constitute the entire agreement between you and us concerning the Services, except for any additional terms expressly agreed to in writing.
24. Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, financing, sale of assets or similar business transaction, subject to applicable law.
